Subject: Question regarding second pull and refile

Dear all:

If the acquiring person pulls-and-refiles its HSR filing a second time in hard copy (i.e., paper), and thus pays the filing fee again, do you agree that the acquiring person must only submit with the HSR Form any new Item 4 documents in hard copy, and that it need only incorporate by reference (e.g., in a cover letter or index) any Item 4 documents submitted in hard copy with its original HSR filing and its first re-filed HSR filing?
