In accordance with the terms of a final consent order reached with the Commission, the following has applied for approval of non-affiliated Internet service providers (ISPs) and alternative cable broadband ISP service agreements: America Online Time Warner, Inc. (AOLTW, or the Respondent). Paragraph II.A.2 of the order, which was finalized on April 17, 2001, requires that in each Identified Cable Division listed in the order (such as, for example, New York City and Tampa Bay, Florida) Respondents -- within 90 days after they make an affiliated cable broadband ISP service available to any subscriber in that Identified Cable Division -- must enter into alternative cable broadband ISP service agreements (which have received the prior approval of the Commission) with at least two non-affiliated ISPs (which have also received the prior approval of the Commission) to make additional non-affiliated cable broadband ISP services available to subscribers in that Identified Cable Division. Through this petition, AOLTW has requested Commission approval of: 1) Juno Online Services, Inc. (Juno) and High Speed Access Corp. (HSA) as non-affiliated ISPs; and 2) the alternative cable broadband ISP service agreements entered into between Time Warner Cable and Juno, and between Time Warner Cable and HSA.
