16 CFR Part 455 Used Motor Vehicle Trade Regulation Rule; Project No. P087604
PLEASE DECLINE THE "USED CAR RULE". As written, the rule would only make it easier for Used Car Dealers to mislead the public about the nature of the product they are selling. Putting in fine print that buyers essentially shouldn't trust the car dealer, is simply a way to assume that 1) the buyer was made aware of the clause, 2) that they are not relying on the dealerships extensive knowledge and expertise and 3) assumes that buyers will be given the opportunity to have the car inspected before purchase. This is not fair as most consumers are relying upon what the dealer tells them about the car. The new rule is a bad idea and could lead to Consumers not seeking help for fraud or worse, that Court's dismiss valid cases of fraud, interpreting that the rule gives dealers a "pass" on actionable fraud also.
