16 CFR Parts 317 and 318: Mortgage Acts and Practices Rulemaking
My comment is that not all banks is providing the assistance that a current homeowner is requesting. One bank in particular has informed the homeowner that they should consider refinancing instead of modifying their existing loan. The homeowner had already refinanced out of an ARM prior to the ARM changing. The homeowner does not have money to refinance but is asking to modify their existing 30-year fix since the homeowner does qualify under one of the requirements for modification. However, the Bank keeps pushing the homeowner to refinance when the owner cannot afford to do so. Therefore, the homeowner will be late in payments. If a Bank is receiving stimulus assistance to help homeowners, why doesn't this Bank want to help to modify the loan.
