Regardless of the ruling in this matter, I will continue to believe that it is unethical to intentionally recruit students currently happily studying with a FELLOW (we are not rivals) teacher of the same instrument, in the same area. I have not and will not personally do so. Studying music is a much about the relationship between the student and teacher, as it is the student finding the "cheapest" price. It is worth noting that we fellow teachers actually often recommend our students to other teachers when our studios are full, our schedules don't fit the student's needs, or for any other reason we feel the other teacher would be a better fit for that particular student. We work together for the betterment of our students and the world, we do not compete against each other.
