Statement of Policy Regarding Communications in Connection with Collection of a Decedent’s Debt, Project No. P104806
This is a very bad change to our laws. Under British law it is illegal to adhere debt to someone who was not party to it during their parent's life. This makes perfect sense. What if you have a dirtbag parent that you never knew, but that parent racked up a bunch of debt. Would you be liable for it? And what if you have no income, but your parents had lots and died in their prime money-making years? Would you be liable for their debts that far outweigh your ability to pay? If you have a friend that is buying things and you know that they do not have the ability to pay it back or that they are just generally living above their means, is it appropriate to apprehend them and turn them over to the police as they are effectively stealing from you? This change makes no sense. Please do not enact it.
