I disagree with the definition of the restraint of trade issue the FTC has identified regarding the MTNA Code of Ethics, (MTNA COE) proviso that prohibits teachers from soliciting other teacher students. The MTNA COE only applies on property controlled by the MTNA. The reality is that member teachers hold auditions and performing festivals where their students are evaluated. If fellow members were able to solicit students away from other fellow teachers at or during these events-these student opportunities would most likely cease. This would reduce the professional raison D'etre of the very organization. Which would greatly reduce the educational value of private music lessons. The MTNA COE does not stop any legitimate marketing competition between teachers outside of MTNA sponsored events.
