Statement of Policy Regarding Communications in Connection with Collection of a Decedent’s Debt, Project No. P104806
I feel strongly that the language of the legislation to assist debt collectors in recouping funds owed from the estate of deceased individuals must be written in such a way as to protect relatives of the deceased's family. I feel there could be opportunities in which confused or weak-minded individuals could be compelled by unscrupulous debt collectors and debt collection agencies to provide funds to repay debts they are not personally obligated to pay. The language must clearly state that any funds obtained to resolve debts must come from the estate of the deceased. My spouse died six years ago and I endured numerous unpleasant calls from debt collectors during a time when I was not thinking clearly. My father died eight years ago and at that time my mother, my siblings and I endured similar phone calls demanding that we replay his debts. I can testify from relatively recent experience that though I had my wits about me, some of the claims made by the debt collectors were confusing. If I had not taken the time to think about their demands and discuss them with clear-headed friends, I might have given in to their unreasonable and illegitimate demands. Thank you for ensuring that unscrupulous individuals have less opportunity to take advantage of persons who's thought processes have been affected and possibly impaired by extreme grief.
