Debts of a deceased when alive were made often without knowledge, assistance or consent of surviving friends and relatives and should legislation or rule-making language should not be attempted to widen this stance, as it is unfair, capricious and unjust. Many creditors accept this risk especially credit card issuers which push cards on consumers. If assets are available in the estate probate process, there is an orderly way for estate executors, overseen by probate courts, to liquidate debts in a systematic manner. Simply put, debts not jointly held, should be the sole responsibility of the debtor, in life or death.
