Statement of Policy Regarding Communications in Connection with Collection of a Decedent’s Debt, Project No. P104806
While a debt doesn't disappear when a person dies, neither does the privacy of their friends and family. To my mind a debt collector should only discuss the debt with whomever has the authority to pay. Discussing the debts of a deceased person with mourning family or friends that don't have the authority to pay the debt is cruel. Furthermore if a debt collector implies that a person has a moral obligation to pay a debt, to a person has no legal obligation to pay the deceased debts. Then the debt collector should be punished by a fine twice that of the debt or some amount that will keep them from doing that.
