Proposed Consent Agreement In the Matter of Watershed Development Corp., also doing business as Watershed and Aaron’s Sales & Lease Ownership, FTC File No. 1123151
Did you not discover or read what is called a rental contract? That these computers were only equipped with the ability to install software after they were stolen? That the person renting the computer would never be violated because they have a contract stating such? That the computer displays every time it is turned on the license? How can you say that when I am renting this computer that any of this happened? I pay my rent on time as I contractually agreed to and for that they agree not to report the computer stolen. For this, I get a nice discount. If I do NOT return the computer and I have moved, I know damn well that they can turn on the webcam and see where I am. This is all clearly spelled out to me. So you either talked to people trying to ripoff the industry or you found an isolated group of vendors out there not disclosing properly. Also you are not regulating the industry. If you look around, you will see several other programs that do the same thing and you might have prevented this software vendor from selling it, but you didn’t stop any of the others. Also, you failed to mention that many NEW computers from companies like Dell, HP, and others come with this software pre-installed. So again, the issue is disclosure and not a problem with software. Bottom-line is this, these software packages exists because people steal computers or they get lost. These packages are all over the internet with example after example of computers that were stolen being monitored. I see nothing but my rental store protecting their property and protecting me if it gets stolen.
