Request for Comments "Real Estate Workshop"
Thank you to the Commission for this public forum offering homeowners a voice. Echoing a previous poster.. Per state laws, the real estate client owns his or her client file. The listing agreement permits the MLS to take on a duty with an expiry date. Nothing else. There is no license or assignment. At expiry, the parties revert to their original position. If the MLS then uses the client file in any way, technically, it has breached the agreement. If the client directs the MLS to erase the file, and the MLS refuses, this is a denial of rights.
