Sanctioning the sale of dangerous vehicle by requiring a "disclosure" is a very bad policy, and an invitation to fraud and deception. Auto dealers are infamous for, and expert at obscuring, discounting and concealing negative information. Selling a known unsafe vehicle, while advertising and promoting it as "certified," "100+ point inspected," etc., is contrary to the public perception of "certified" vehicles-- that dealers so heavily promote and charge a premium for. Approving such sales on the condition of disclosure, will also insulate dealers from legal liability for fraudulent practices where dealers can simply point to the legal "disclosure" that "complies with the law"-- end of story for deceived and unsophisticated consumers who are the principal victims.
