The matter concerning whether or not a company has to use a third-party to sell it's product or not, should not even be a debate. If this was any other industry there would be no question that the company can directly sell it's products to consumers. Without this, e-commerce would dwindle to a handful of large companies and never allow room for growth of smaller start-ups. Imagine never purchasing a single item from an Apple store, but always having to go through a cellular provider or a box store. The US state governments should not be allowed to prevent direct sales to consumers. It is a clear violation of the values and purpose of the FTC if they do not allow companies to sell their products directly to consumers.
