16 CFR Part 315; Agency Information Collection Activities: Review; Comment Request; Contact Lens Rule: FTC Project No. R511995
This rule is not well regulated. Third party sellers find ways around the rule by letting patients order more than a years supply during the year. We have patients that have been wearing contacts for the past 5 years without having an eye examination. Third party sellers make it hard for the practice to verify these rx requests by having an automated playback of the prescription without doing it with a live caller. The automated system tells you the rx power first, then brand, then the patients name so it makes it tough for the staff to verify when they are trying to help other patients at the same time. Also, third party sellers will fax the rx verification request on a day your office is closed or after hours. With the law requiring offices to verify the rx in 8 hours, it makes it very hard for the doctor to comply. This results in sellers filling the rx anyway and ultimately higher health risks to the patients. Please extend the time limit for doctors to verify rxs longer and please also require sellers to provide a live person to call the office when they are trying to verify an RX.
