16 CFR Part 315; Agency Information Collection Activities: Review; Comment Request; Contact Lens Rule: FTC Project No. R511995
As a prescriber, the biggest issue I have is the way the law is written to allow outside vendors to fill contact lens prescriptions. Now, if we get a fax and do not respond within 24 hours, the vendor can fill an expired prescription. This is a problem on weekends when we are not in the office for 2 days, or on a particularly busy workday when staff cannot get to the fax the same day. This allows dispensing of improper contact lenses (including ones substituted by the vendor or simply requested by the patient, but never evaluated by the doctor - I have seen this happen). Vendors also fill prescriptions before the 24 hours. There should be stricter laws that do not allow dispensing of non-prescribed lenses as the default.
