The Fairness to Contact Lens Consumers Act has had a great impact on my practice and patient health over-all. The passive verfication rule needs to be changed and there needs to be some teeth in the form of authority to pass penalties to companies that do not comply with the rules. Online contact lens distrubutors if they call at all for verifcation often ignore contact lens parameters and expiration dates. I've had patients that I've not seen for 4+ years and are still getting contacts through on-line sources and often the wrong script! Not once was verification checked. There needs to be a way to penalize these companies that do this. Contact lenses are medical devices and I've treated many cases of contact lens related complications including bacterial infections and uclerations, poor fitting lenses causing inflammation, scarring of the cornea due to poor compliance among others. Please review and consider giving this law the teeth it needs. I don't mind competition. I don't mind patients getting contacts from other sources than my office, but it needs to be on a fair playing field and these companies that distribute medical devices should be holden to the same medical ethics and rules as I am.
