I have had many patients who abuse this act. They: Try to order contacts that they were not fit in (this can cause serious damage) Try to order contacts where the prescription has been expired (7 years expired is my record for what has been attempted to order) Try to order contacts that were never fit (has only done glasses exam on the patient and sometimes has never worn contacts) They have never been my patient (they probably just picked me off google and hoped I wasn't in or did'nt catch it). This regulation has been used by vendors to sell without needing a proper exam or fitting, its basically allowing these vendors to be flee markets for medical optical devices. I think that this regulation muse be sited for someone getting hurt before the regulators consider that people use these medical devises to drive and can just as easily be brought up on negligence for collateral damage if vendors are allowed to dispense without proper documentation and records from the optometrist that is prescribing.
