I agree with the FTC's decision to recognizize that the merger of SCI and Stewart would harm competition in the Jewish funeral home market in the DC/MD area. However, the proposed remedy of requiring the divestiture of Edward Sagel Funeral Direction is not nearly enough to make a difference. The exclusion of one small funeral home (Sagal) from the purchase is not enough to maintain competition. Danzansky and Hines Rinaldi are the two primary competitors in the market and if SCI owns both, it will have the ability to effectively eliminate all competition. It will harm the community if these two fierce competitors were to be owned by the same organization. I urge the Commission to revise the proposed consent decree and require the divestiture of Hines Rinaldi.
