The Federal Trade Commission requires that persons filing a Hart-Scott-Rodino (HSR) notification with respect to a proposed transaction use the North American Industry Classification System (NAICS) to report their revenues in Item 5 and certain overlap information in Items 7 and 8 of the Notification and Report Form for Certain Mergers and Acquisitions (HSR Form).

All persons must submit data on non-manufacturing revenues at the 6-digit NAICS industry code level. To the extent that dollar revenues are derived from manufacturing operations (NAICS Sectors 31-33), data must be submitted at the 10-digit product code level (NAICS-based codes).

As of August 18, 2011, filing persons must use the most recent NAICS reporting year in their response(s) to the HSR Form. 76 FR 42471 (July 19, 2011).
