Claims about employment prospects and income levels are like any other objective advertising representation – and Job #1 for advertisers is to support those promises with solid evidence. DeVry University and its parent company have entered into a $100 million settlement to resolve the FTC’s allegations that the defendants’ claims didn’t make the grade.

According to the FTC, DeVry violated the law by deceptively claiming that 90% of its grads actively seeking employment landed jobs in their field within six months of graduation. The complaint also challenged as misleading DeVry’s representation that one year after graduation, its bachelor’s degree grads had, on average, incomes that were 15% higher than the incomes of bachelor’s degree grads from all other colleges and universities.

How will the $100 million settlement be distributed? DeVry will pay $49.4 million in cash to qualifying students who were harmed by the deceptive ads. The proposed order includes an additional $50.6 million in debt forgiveness. That figure represents the full balance owed on all unpaid private student loans issued to DeVry undergrads between September 2008 and September 2015 – $30.35 million – plus $20.25 million in student debt for things like tuition, books, and lab fees.

But that’s not all the defendants will be doing for students the FTC alleges were deceived. The order also requires DeVry to:

  • directly notify consumers who will be receiving debt forgiveness;
  • inform credit bureaus and collection agencies of the debt forgiveness;
  • release transcripts and diplomas that DeVry withheld from students because of outstanding debt and cooperate with future requests for diplomas, transcripts, and related enrollment or graduation information; and
  • set up a dedicated telephone hotline where consumers can call with questions about debt forgiveness, their credit reports, or collections concerns.

The settlement also includes provisions that will change how DeVry does business from here on in. Among other things, the order prohibits DeVry from misrepresenting the likelihood that graduates will get a job as a result of their degree. In addition, if the defendants want to make future claims about its graduates’ success in finding jobs near graduation, they can’t include jobs that students landed more than six months before graduating. The settlement also prohibits DeVry from misrepresenting the compensation students or grads have earned or can expect to earn.

What lessons can others can learn from the FTC’s action against DeVry University?

1.   For many consumers, education is the second-largest purchase they’ll ever make. Companies in that sector and within the FTC’s jurisdiction are held to the same truth-in-advertising standards as any other business.

2.   Say “substantiation” and some advertisers erroneously assume the term refers just to things like health claims. Wrong.  If your company makes any objective representation expressly or by implication – including statements about employment or earnings prospects – you need solid proof to back up those promises.

I have a dispute with Devry going now as i exited before i got set up full of outrageous debt. I have a federal loan and some private Loan they claim they gave. I surely hope this is forgiven and i can find out soon because it's hendering my chance at closing on my home.

Hi everyone, I just called the school directly and they informed me that I was not on the list. Per that phone call with the school, anyone that has federal loans and private loans are not being refunded anything. I inquired about having paid the school partially, directly during my time and that also did not have any relevance. This is very, very unfortunate as I am sure thousands of people have been anxiously awaiting to find out if they qualified since the FTC had such a vague language regarding the situation. Remaining amounts for those that have loans through DeVry are being a racist and the only refunds are those that have already paid towards their loans specifically through devry

Essentially this did absolutely nothing for most people. Do not expect any relief any time soon.

I attended Keller from 1996-1998. I received 2 Masters Degrees. I never received any help with job opportunities as I was promised from Keller. It does not seem fair that Devry students are the only ones that have this opportunity.

It wouldn't make sense why federal loans would not be included in this. I went to school through those dates and dropped out because I figured I can make my way through self study and certifications, which I did all without the assistance of this ludicrous diploma mill's help. I was disoriented by the sub par education and lack of actual knowledge that can only be through self study and experience. I have that debt over my head and have lived a much lower quality of life because of it. My parents could not afford to pay the tuition so I took out loans and the only ones that were available to me were the federal loans. Which I learned about through Devry, all the financial processes were handled by Devry, and as far as I'm concerned Devry fooled me into thinking that I was actually going to benefit from having this debt.

Hi, I had a bunch of Sallie Mae Private/Federal/sub/unsub/direct Loans that Devry would always take care of for me and i would just attend class it seemed, would those fall under whatever they(FTC/Devry) are refunding? I then consolidated them to a FedLoan.gov Loan after about a year or two and so it paid/closed off my Sallie Mae Loans. Would that amount that was paid/closed off to Sallie Mae be refunded to me? Thanks, impatiently awaiting an email from FTC or Devry.

I had an out of school balance in the amount of 1,700.00 from 2012. I was unaware of the balance due until I went to register for my masters degree and was informed that since there was a balance due of 1700.00, I would need to satisfy the payment in full before I could register. I have paid 1200.00 and I have a balance of 500.00 still outstanding, Will I be refunded the 1200.00 that I have already paid and will the balance remaining (500.00) owed be expunged? Lastly, I was never able to receive my Official Transcripts...Will I be receiving my Official Transcripts as well?

I received notice from FTC regarding the case over a month ago then again regarding notification of the settlement. My personal loan from Devry now has a zero balance and last months payment was returned to me. But to answer your question, No Devry has not sent any notification what so ever.

What happens to students who used Federal Student Loans to get their education? I attended DeVry and Keller between the dates however, I did not take out any private loans and I did not land a job of any kind for a year after I graduated. What about people like me? Please help!!!

Federal Loans are not included. My private loan through Devry has a zero balance now, but I still have to pay the Fed Sub and UnSub loans. They are from the Gov. not Devry. I know, that part is not sitting well with many borrowers.

Hey, I was reading an article online that students who receive an email are the only ones who are getting loan forgiveness or a refund is this true? I attended devry aswell and have not received an email from them. Is there anyone who I can talk with about this?

I received an email from them at the beginning of January. Checked my loan from DeVry directly and that was forgiven with a zero balance now showing and Decembers payment was refunded as I paid after Nov.30. This was a private loan that I had gotten from DeVry. Have not gotten anything further whether a refund for the first half of the loan that I already paid will be paid but hoping so.

I fell for this school. My grandparents paid the tuition for this school in full with no loans paying the balance directly to DeVry each semester. I am now working a 12 dollar per hour job in a tire store I graduated in 2002.

I have stumbled across this article today. I am still attending Keller Graduate School of Management through DeVry and have student loans to pay for my education. You can imagine how I now feel learning that the school I am attending falsely led and misrepresented itself. I enrolled in August 2016 - missing the deadline completely. To read the comments that employers are not recognizing the school as being credible has really made me feel used. I am a Graduate Student and believe I had made a sound decision about furthering my education. What a way to let air out of my balloon. Please advise if there is any recourse since the date in question is outside of my timeline.

Most of these comments relate to the private loans that were forgiven. That was only half of the settlement. The other half of the settlement was going to be refunds. My guess is that the amount will be fairly small because the $48 million (or so) is spread out among a lot of former students. Has anyone got any information about the refunds?

Just spoke to an ftc rep and asked the same question. Devry notified students regarding debt forgiveness for those in the qualifying list. Regarding everyone else as far as refunds, the ftc has yet to notify students as they are I guess crunching #s before they issue refunds to those who paid but unknown when that'll be. Rep stated possibly in a couple of months.

I would like to know who can I contact regarding the multiple fraud and deceptive practice that I experience with DeVry starting 2013-2016. Devry caught my attention by their deceptive ads on television, the high job rate their graduate experience after graduation and theirexcellent job placement service. I had lost my job of ten years and the tv ads got my attention. I even received e-mails from an admission advisory insuring the job success after graduateion. My life become a disaster with my decision to attend DeVty. I end up with over $ 70,000.00 worth of student loan, even course was added to to my loan that should not been added.. The most devastating thing is, I don't have a degree.. What can be done about my situation, VERY DISAPPOINTED!!

How do we find out about the FASFA / Sallie Mae loans? I was also sucked into their lies and received no help finding work from them. I attended DeVry between 96 - 99? We should receive debt relief too, I wasn't able to ever find work in my field. Have been struggling with huge debt ever since!

The ftc is a joke to the consumers. A pure joke. This settlement is a joke. They won't explain how they came up with the reward. The ftc most likely did under the table type deal. 100 million is alot... Jk it's should be in the billions. 100 million if so were to go back to the students it would cover... 50k average per student.. Covers 2000 students. There are 40000 students attending. that college makes more than the state of Missouri. I love how the government let's them spend half of taxpayers dollars on advertising. But government let's colleges bankrupt but not students... Scammed and lost A leg. Debt for life. Rather die than to pay the greedy government back

I believe those that have been notified regarding private loans from DeVry have been paid already. This has nothing to do with the federal loans taken out to attend the school. The other half of the refund appears to be for students who paid out of pocket may qualify for reimbursement but may not be the full amount. Hope this helps.

I don't think its fair to only go back to 2008. I graduated in 2005 and my student loans have doubled (to the tune of $125K with the original amount being 50K) because I have not been able to get the type of job I was promised/guaranteed by Devry to make the necessary money to pay the loans.Their deceit started long before 2008

This doesn't forgive loans provided by Naviant, which isn't fair since all of my paperwork was done through DeVry. If they chose for my financial aid to go through Naviant they should still be forgiven as they were fully set up though DeVry.

I think we meaning anyone that attended DeVry got the the short end of the stick. All students who attended this University were sold the same bill of goods, no matter what year they attended. I happened to be enrolled from 2000 to 2002 was given the same line about putting the Universities name on my application and would be guaranteed a good paying job. I was also made to have the Measles , mumps and Rubella shot before I could attend the school. Not all the students were required to have these immunization students were selected at random. Why is it that we are not hearing about this. And why was any student excluded from the class action suit?

I want to know who I contact because DeVry/Keller is telling me I have $2k in my account that I have to all of a sudden pay. This is getting to be ridiculous because I have contacted my "student success coach" twice and she does not respond. When I first graduated from Keller, which is, in fact, a part of Devry no matter what you say. The legal papers say Devry/Keller on them. I owed less money and the reason they gave me was that the Financial aid gave me too much money back and I had to sign a paper stating that I will, in fact, pay that back with my financial aid, now I owe a lot more to the school and the funny thing is something like this happened when I finished up my bachelor's as well.. Devry/Keller are just a bunch of scam artists and I regret going there!

Devry is a spam and have poor education they just want money. They also kept my grants and that it was recommended to turn them in for you to get another class. They mislead/distorted and gave false impression. I was amazed when I investigated Devry University about there bullying towards each class session amount charge. Can I get my Loan Discharge?
