COMMENTS ON PROPOSED RULES, REGULATIONS OR AGENCY ACTIONS:A consent order is usually an order that is negotiated by the parties and represents a negotiated settlement. The proposed order lambasts Motorola for conduct that was probably not clearly against the law at the time that it occurred. I agree with Commissioner Rosch as his analysis is well stated. I am curious as to what impact that this consent order will have on Motorola, Google and the licensing of standard essential patents (``SEPs'') for cellular, video codec, and wireless LAN standards. Also, it would appear that this litigation is second guessing previous court rulings in patent cases filed by Motorola.
