Re: Used Car Rule Regulatory Review, Project No. P087604 The FTC should NOT adopt the proposed changes to the Used Car rule. In specific, the proposed language regarding the dealer's buyers guide is essentially a license for used car dealers to commit fraud. A dealer should be obliged to divulge known defects about the car. If a dealer lies about a car or its warranty period, that dealer can and should be held accountable. The proposed rule change is something being suggested by car dealers to excuse themselves from telling the truth and to insulate themselves from a claim of fraud. The proposed change is against consumer interest and it is extremely strange that an organization charged with protecting consumer interests is even proposing it. Requirements for buyers guides should be tightened up, not loosened. Then buyers can make informed and correct choices as to whether they should purchase a car or not.
