Proposed Consent Agreement In the Matter of Tops Markets LLC, a limited liability company, Morgan Stanley Capital Partners V U.S. Holdco LLC, a limited liability company, and The Penn Traffic Company, a corporation. FTC File No. 101 0074
In the Matter of Tops Markets LLC, Morgan Stanley Capital Partners V U.S. Holdco LLC, and The Penn Traffic Company, I will say in your defense that you have made it easy to make comments and thank you for that. I also will say that someone has made a terrible mistake in analyzing that there is an anticompetitive situation with Tops market in the Riverside Mall. This market has provided families and individuals with lower prices and provided a service to this community by doing so. I personally shop very intelligently and see the competitive markets are Price Chopper and Wegmans and Weis Markets who have all made idiots out of consumers by making them think that bigger is better. I have found that in very few circumstances it has been an advantage to go to any of these stores. I do not believe that your decision has been made to provide any service to shoppers in the Cortland areas that surround the area of Riverside Mall. I ask that you reconsider your decision and possibly survey people who are shoppers in Cortland and get a fair analysis of whether or not Tops Market is being anticompetitive. I look forward to hearing about the work you will put into making your decision and how you will resolve this. Sincerely, Colleen Hamilton
