In my opinion, under the Tenth Amendment of the Constitution, the FTC has no power to administer or enforce regulations conceived or written by itself, but only laws duly created by the Congress and held to be Constitutional. Therefore, since the First Amendment prohibits Congress from making any law that abridges the freedom of speech, or of the press, or the right of the people peaceably to assemble, the FTC has no authority to make regulations at all! This obvious intended circumvention of the Founder's concept of "Checks and Balances" must not be tolerated.
