Proposed Consent Agreement In the Matter of Phusion Projects, LLC, Jaisen Freeman, Christopher Hunter, and Jeffrey Wright, FTC File No. 112 3084

Four Loko should be left free to sell its beverages to willing adult consumers now that it has agreed to accurately disclose its alcohol content. To the extent that Four Loko misrepresented the amount of alcohol contained, the federal government was right to take action against them. But as long as there is no fraud or misrepresentation, the government should not further regulate or restrict the seller's choice of serving size or alcohol content. Consumers can and should be free to decide for themselves whether or not they wish to purchase Four Loko drinks.
