Statement of Policy Regarding Communications in Connection with Collection of a Decedent’s Debt, Project No. P104806

As the grieving daughter of a recently deceased mother, I was recently contacted by a debt collector who informed me that my mother left me the beneficiary of a credit union account. This same person then immediately said mother had an outstanding mortgage balance with them. She proceeded to tell me the amount was "low" for a mortgage and what would I like to "do about it." She didn't bother to tell me at the time that my "inheritance" as beneficiary had already been confiscated by them as payment toward the debt. She was trying to use it to lure me into paying this debt. My mother died intestate and her estate consists of a house in very bad repair. My brother and I cannot afford probate much less the cost of emptying and repairing that house. This debt collector has since been calling my brother as have all of our mother's other debt collectors. He has told them he has no money to pay her debts as he has been unemployed for 2 years with no benefits remaining and is perilously close to losing his own home. They ignore this fact and continue to harass him. I sit here worried they will start contacting me constantly as they are doing to him. I have a disabled child to take care of and am not in any position to pay her debts either. Please stop these people from harassing grieving relatives. The debt collectors do not care if you tell them you cannot pay the debt. They call often and steadily get nastier and nastier. Thank you for your consideration.
