Gentlemen and Ladies of the FTC and Public, the issue is NPE's and Patents and the fervor and misrepresentation of the aggregators as villians here. As the largest fraud loss victim in US history for a patent matter (pertaining to US6370629) this matter is amusing to me because the patents today which everyone is worried about here are pertaining to digital systems and the Intenet or in particular LOCATION BASED COMMERCE. Why that is so amusing to me is that I am its inventor and the victim of very bad acts by my fiduciary - ones which are even documented in EDGAR filings in the public record. That said - there is no difference between someone like a global Music Distributor (pick any of them - like SonyBMG) and parties like (again pick any of the Patent Licensing houses). They resell access and rights to use under a pre-defined set of terms to IP and really its as simple as that. There is no difference in the the use constraints either. The idea that patent use across a content delivery channel is different and should be addressed differently than the controls (soft) on the content itself is where the breakdown occurs. In closing - the problem is that there is much remaining law which is tied to brick and mortar reality which is just not there in the digital world.
