I do not think Nissan's advertising in this case was deceptive at all. First, it included a disclaimer at the beginning of the advertisement. Second, anyone with even the slightest bit of driving experience would know that such a fictionalized demonstration as presented in the ad would be physically impossible in the real world. If the FTC must make advertisers cater to a rather low common denominator in terms of viewer intelligence/credulity, then creativity and innovation in advertising goes out the window to the detriment of the much larger majority.
