Do not create another loophole in the No Call legislation. Organizations that would like this loophole are simply wanting to advertise. To be interrupted at dinner by obnoxious telephone ads does not, nor did it ever, sell me anything. Rather I'm likely to cancel my account from a business that would use this loophole to bother me.
