This loophole does not need to be opened. Many disreputable telemarketing firms already abuse the "prior business" excuse to absurdity, and creating this loophole would only worsen the problem. Leave the Act as it stands. It's become bad enough at my home that I don't answer phone calls from numbers I don't know (including Private and Restricted numbers).
