I am strongly against any allowed telemarking to numbers on the do not call list! In particular, pre-recorded messages are simply phone spam. This was made painfully clear during the presidential race, since politicos were exempt from the do not call list. Some days we would received 12 or more such calls in an evening! If allowed, they should be required to identify the message (CID) as pre-recoreded, or some such. However, I emphasize that I would consider this to be a failure of the FTC to protect my right of privacy!
