This proposal defeats the purpose of the Do Not Call Registry, which is precisely why it has been proposed by telemarketers. If I ever in recorded memory had contact with a company, for any purpose (including answering a phone call, requesting a rebate, buying a product from a company that tracks purchases via credit card or membership card, etc), the company could and most likely would view that as having an established business relationship within the scope of this proposed change. The FTC should not work with telemarketers to use an agency rule to circumvent the intent of Congress.
