Under FTC Textile Rule 303.12(a)(1), if the threads are “elastic materials and threads inserted in or added to the basic product or garment in minor proportion for holding, reinforcing or similar structural purposes,” then they are exempted from disclosure.
The challenge for the industry is in determining what is considered minor proportion. Can the FTC provide a definition for minor proportion.
