I am pleased to comment in support of the consent agreement settling alleged violations by Phusion Projects. I have always felt that Phusion’s can labels have always clearly conveyed exactly what’s in them in bold, capital letters – 23.5 ounces and 12 percent ABV. I also believe that their labeling already goes well beyond industry standards with six different statements in 10 locations regarding the alcohol content and the need for an ID for purchase. New, additional label information will give consumers even more information. I understand that as a result of the agreement with the FTC, Phusion is developing a new, resealable can for its current 23.5-ounce, 12 percent ABV Four Loko products. This resealable can offers many consumer benefits such as, an informative, new design that is easy to use, spill-proof while retaining carbonation. This innovative package will give consumers more flexibility in the way they choose to enjoy Phusion products. In summary, I feel that underage drinking and alcohol abuse are serious problems in need of serious solutions. However, they will not be solved by arbitrarily singling out specific products or an entire alcoholic beverage category. Thank you for the opportunity to share my comments on this important issue.
