The current Guide can be read as inviting a weight loss testimonial that the advertiser knows to be false and deceptive -- for instance, by a badly confused consumer -- simply by pairing the claim with a notation of 'the limited applicability of the endorser's experience to what consumers may generally expect to achieve.' Time and again we see that advertisers accept the Commission's invitation by running photos and videos of happily slender consumers, with the outrageous claims seemingly immunized by a Commission-blessed disclaimer. The sooner the Commission withdraws its endorsement of this kind of scam, the better.
