I have written, spoken, and testified against mandatory pre-dispute consumer arbitration. Attached is a copy of my most recent article. As the article more fully discusses, besides being unfair and unbargained for, consumer arbitration is inconsistent with our system of government and the essential role the courts play in protecting consumers.
