In addition to the criteria you've posted, I believe there should be something that would cover the spam that seems oriented towards determining if the spammer has a live e-mail or not. These are often non-sequiters or simply blank, but otherwise have the earmarks of a spam e-mail (blocked "to:" list, invalid return address, etc.). BTW, I've seen no evidence that CAN-SPAM is working. My spam filter software reports that in the last 9 months, 85% of what I've received is spam.
