RE: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners: I believe that your efforts to curb the problem of unsolicited e-mails is much needed. After all, in spite of using a spam filter I still receive more than 100 hundred unsolicited e-mails per day. However I am concerned about your proposed requirement that merchants maintain suppression lists. I would ask that your consider the matter carefully, for the following reasons:  Many legitimate publishers have already taken measures to ensure that people receive only the material they subscribed for. Most do not sell, rent, or loan lists and are careful to use distribution software that requires a ‘double opt-in’ by potential subscribers. Why limit these legitimate publishers by requiring them to require additional, in-advance permission. This is a difficult if not impossible requirement to meet. Non-Internet businesses advertise their wares why can’t responsible Internet businesses do the same, particularly when we make every effort already to ensure only those who are interested in our services get e-mails from us.  Those who are currently engaging in spamming, many who operate ‘off shore’, are not likely to attend to this measure. I can testify that since the law went into effect spam has grow not diminished!  I am concerned that these suppression lists may themselves fall into the hands of unscrupulous parties and become further fodder for spammers Again, I urge that you please carefully examine the need for and mechanisms whereby such suppression lists are implemented.
