Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I applaud and wholeheartedly agree with your efforts to reduce the growing problem of unsolicited bulk email (spam), which threatens the future of the internet as we know it. However, I am very concerned about how the proposed requirement for merchants to maintain suppression lists will in fact be operated. The most restrictive method of operating suppression lists will cause great problems and high costs to businesses without providing much in the way of benefits to consumers. The real problem with spam is with those who operate outside the law and will continue to do so, whatever restrictions are put on legitimate businesses. I subscribe to many newsletters and email publications and have very few problems where a genuine opt out link is provided. If my email address was then put on a suppression list, my concern would be if that list was or could be accessed by a spammer illegally. If this happened through hacking it would increase the amount of spam - not reduce it. It would not concern me if suppression lists were not used at all. I think they could prove a great liability. My other dislike of suppression lists is the need for my email address to be passed around merchants and affilites so I will not receive another offer of this product. Again the possibility of the email address falling into the wrong hands far outweighs any benefit to me. If I received another offer , I just delete it. This has not been a problem. Requirement of the use of suppression lists to their full extent will cause great difficulties for legitimate business while having very little effect on the amount of spam I receive. I am very concerned at the potential problems this ruling in its fullest extent could involve, and urge you in the strongest possible terms to reconsider its implementation in light of these problems. You have done a good job in the war against spam, but feel implementing this ruling too strongly could rebound on your good work so far.
