Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I approve your efforts to curb the problem of unsolicited bulk email. However, I am concerned with the proposed requirement for merchants to maintain suppression lists. In a time when the economy is causing many to enter into ecommerce business to earn a living, the many problems and costs associated with this idea are excessive. Too much damage will be done to consumers and businesses alike. I feel I must avidly urge you to consider this matter most carefully. Requiring of the use of suppression lists will seriously damage the many legitimate publications available on the net. My specific concern is the damage to publishers who already require permission from the consumer prior to adding them to any list. They are not the ones CAN-SPAM was designed to put out of business, but this requirement will most likely have that effect on legitimate business. Then there is the potential for significant harm to consumers, with the problem of properly understanding intent when they unsubscribe from a list. Additionally, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. I was extremely surprised at the potential problems this ruling could initiate, and urge you in the strongest possible terms to re-evaluate its implementation in light of these problems and until potential problems can be examined.
