Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, The problem of unsolicited bulk email is growing and I agree that measures need to be taken to control this. However, I am concerned that legitimate businesses that use e-mail responsibly will be penalized, particularly in relation to the proposed requirement for merchants to maintain suppression lists. The problems and costs associated with this idea are numerous. In addition, so much damage will be done to consumers and businesses alike, that I feel I must urge you to consider your actions relating to this matter most carefully. Instead of making it more difficult for 'spammers' to continue their operation it appears the requirement of the use of suppression lists will only serve to seriously damage many of the legitimate businesses and publications available on the web. My main concern is that this proposal will only harm all those publishers who use their e-mail lists responsibly! These are not the people that CAN-SPAM was designed to put out of business, but this requirement will almost certainly have that effect. In addition, has any thought been given to the implications if these suppression lists fall into the hands of 'spammers', this will surely lead to more spam! I am shocked at the impact this will have on responsible, legitimate bussineses and the potential problems this ruling would involve, I therefore respectfully urge you, in the strongest possible terms, to reconsider its implementation in light of these problems.
