Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, Uunsolicited bulk email is clearly a problem. However, I am deeply troubled about the proposed requirement for merchants to maintain "suppression" lists. Use of suppression lists will significantly harm seriously the legitimate uses of email available on the net. My specific concern is for harm to businesses such as our restaurant who require permission from the consumer PRIOR to adding them to any list. Those are NOT who CAN-SPAM was designed to put out of business, but this requirement will most likely have that direct effect and play significantly in HARMING our business. We employ over 200 people in three locations in southeastern PA doing over $5MM in gross annual sales. We are growing rapidly into more locations. Email communications to our current and referred customers plays a SIGNIFICANT role in our growth. We are a legitimate business - not a spam business - and this ruling would significantly alter our current and future growth. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. Suppression lists could VERY easily fall into the hands of spammers, leading to more spam instead of less. I urge you in the strongest possible terms to reconsider its implementation in light of these potential problems.
