Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I support and commend your efforts to reduce the amount of unsolicited bulk email. However I must bring to your attention my concerns about the proposal for anyone classed as a merchant to keep and continually update suppression lists. This has the potential to open an even bigger 'can of worms' than we already have... the extra work, extra costs, the irreparable damage done to consumers and legitimate businesses... it would be like throwing the baby out with the bathwater, I feel I must urge you to consider this matter most carefully. This proposed requirement of the use of suppression lists will inflict enormous penalties and damage to many of the legitimate businesses, merchants and publications available on the net. Many of these are providing a service to the Internet community that will become impossible to maintain. These are not the people who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. Add to that the undeniable fact that these suppression lists would be sought after by spammers and would lead to more spam instead of less. I was very alarmed at the frightening problems this proposed rule could involve, and urge you in the strongest possible terms to reconsider its implementation in light of these problems.
