Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I am required under the Data Protection Act to not share the personal details of my customers with other organisations without explicit permission. An obligation to disclose the identities of customers who had opted out of commucation from my company could be incompatible with my duties under the Data Protection Act. Were this new Suppression Lists ruling to be put into effect, customers who opted out of mailing lists would be at increased, not decreased risk of their personal details being proliferated. I am sure this is not your intention. I believe the overall effect of this proposal would be to cause damage to the law-abiding responsible organisations, without any discernable effect on the activities of those who are difficult to trace. Your valuable time and effort should be directed to solving the underlying issues of anonymity and unaccountability on the Net, rather than further burdening honest organisations who do not evade their responsibilities nor disguise their actions.
