April 16, 2004 Federal Trade Commission CAN-SPAM Act P. O. Box 1030 Merrifield, VA 22116-1030 Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners: Undoubtedly you are receiving a huge volume of feedback on this issue, so I'll be brief. Frankly, "suppression lists" won't stop unsolicited commercial e-mail ("spam"). Compliance with proposed legislation will impose an impossible burden on small business, harm consumers and will actually aggravate the spam situation. What will end up happening is that "suppression lists" will become "spamming lists". Every single e-mail address on such lists will be harvested by "spammers" who will send even more spam. On the other hand, law-abiding citizens may have to discontinue their businesses. I respectfully request that you reconsider your position. Thanks for your thoughtful consideration of this issue. Yours truly, J. Stephen Pope President Pope Consulting Inc.
