Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners: Whereas I agree there is, to some extent, a problem with unsolicited bulk email, I am concerned about the proposed requirement for merchants to maintain suppression lists. The majority of the problem is caused by a few bad apples and to impose such a requirement for the small business home worker would severely affect their ability to continue to do business. The required use of suppression lists would seriously damage many legitimate publications now available on the net. My specific concern is the harm to publishers who require permission from the consumer prior to adding them to a list. THEY are not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that very effect. There is also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. Additionally, these suppression lists could just as easily fall into the hands of the spammers, leading to more spam instead of less. I am quite surprised, and dismayed at the potential problems this ruling could invoke, and urge you to strongly reconsider it's implementation in light of these problems.
