I think you guys are on the right track however, you need to address situations in which the recipent opted into an e-mail list. If the recipient opts in, this email should not be viewed objectional under the CAN-Spam ruling, regardless of the "purpose" of the e-mail. I just dont want the regulations to go into effect and see legitimate businesses be put out of business because of an ommision. A lot of businesses use opt-in list to develop a clientel, in which to promote the prducts they have developed. This clientel is a very specific market due to the nature of an opt-in list. Your attention to this detail is greatly appreciated and I know that you will do your best to make sure that this supresses the real problem... unsolicited e-mail.
