Re: CAN-SPAM Act Rulemaking, Project No. R411008 To the Commissioners, I aggree with your efforts to curb the problem of unsolicited bulk email. However, I am concerned about the proposed requirement for merchants to maintain suppression lists. There has to be a better way to control the problem without hurting entrepreneurs who deliver a service to their customers who have opted in to receive information. The problems and costs associated with this idea will put an end to many small businesses. Given the problems we have today, with companies downsizing and exporting of jobs to India and places with inexpensive labor I truly feel that you must consider the implications to legitimate business owners who are trying to make a living as well as employing people. I don't like spam email any more than anyone else. However, I subscribe and belong to many newsletter list and trade groups that I want and look forward to receiving information from these firms. To deny people of their right to receive data because of a problem with certain spammers is just not the appropriate course of action. Penalizing the legitimate business person and consumers alike is not the way to go. and so much damage done to consumers and I strongly consider you take an alternate look at this situation and reconsider this matter. Requirement of the use of suppression lists will seriously damage many of the legitimate publications available on the net. My specific concern is for harm to publishers who require permission from the consumer prior to adding them to any list. They're not who CAN-SPAM was designed to put out of business, but this requirement will very likely have that effect. There's also the potential for significant harm to consumers, because of the problem of properly knowing their intent when they unsubscribe from a list. On top of that, these suppression lists could easily fall into the hands of spammers, leading to more spam instead of less. This ruling will have a devastating impact to small business, entrepreneurs and consumers. Please, Please, Please take the time to reconsider before moving forward with this program.
