Re: CAN-SPAM Act Rulemaking, Project No. R411008 Commissioners, I appreciate your efforts in trying to stop unsolicited bulk email. That being said, I am very concerned about the proposed requirement for merchants to maintain suppression lists. The costs and problems associated with this proposal as well as damage done to legitimate businesses is something that can not be overlooked. Serious inquiry and discussion needs to happen to ensure that penalties are not being handed out to businesses that have asked for and obtained the right from their list-members to email them regarding the services/products/industry that prompted the customer to sign up for in the first place. There need to be a critical distinction between legitimate publishers and blatent spam violators. Consumer's privacy needs to be protected as well, and knowing their intentions when unsubscribing is important. Supression lists would also be subject to interception by SPAM houses which is a very scary thought. In my opinion, this ruling would cause many more problems that it would solve and I strongly urge that this issue be discussed in much greater detail with a longer period of publisher input before decisions are made.
